An adviser’s notes, written before the current regulatory regime was fully implemented, have helped decide the outcome of a case before the FSCL ombudsman.

However, the ombudsman says that while the notes were useful in making a decision in favour of the adviser, they may not have been good enough if relied upon under the current regulations.

In the recently-released decision, the FSCL states that while the adviser did not make full diary notes, the notes “…were adequate to show it was more likely than not that the adviser” had acted correctly in not adding a child to a family’s health policy.
